Terms of Use
1. Acceptance of terms
By accessing or using ticx.com.au ("the platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the platform. These terms constitute a legally binding agreement between you and TICX Pty Ltd (ACN 611 857 875), the owner and operator of ticx.com.au.
We may update these terms from time to time. Continued use of the platform after any changes constitutes your acceptance of the updated terms.
2. Nature of the platform
ticx.com.au is a listing and enquiry marketplace only. We are not a licensed real estate agent, broker, lender, financial advisor, investment advisor, or legal advisor. We do not conduct, facilitate, or participate in any property transaction.
All property transactions are conducted directly between buyers, vendors, and their respective licensed real estate agents, entirely outside of this platform and in accordance with applicable Australian state real estate and property legislation. Nothing on ticx.com.au constitutes an offer to buy or sell real property, a financial product, a security, or an investment.
Important: ticx.com.au does not verify the accuracy of any listing, the identity of any user, the ownership of any TIC share, or the financial capacity of any buyer or vendor. All users must conduct their own independent due diligence before entering into any transaction. Always seek independent legal, financial, and tax advice from qualified Australian professionals.
3. Listing terms
By submitting a listing to ticx.com.au, you represent and warrant that:
- You are the owner of the TIC share being listed, or are duly authorised to list it on behalf of the owner
- The information provided in your listing is accurate, complete, and not misleading
- The TIC share is legally capable of being sold and transferred under applicable Australian state law
- You hold all licences required by applicable Australian state real estate legislation to list and sell the property interest
- The listing does not violate any applicable law, regulation, or third-party right
Individual vendor listings are charged at A$99 per annum. Licensed agent subscriptions are charged at A$198 per annum for unlimited listings. Listing and subscription fees are non-refundable once a listing has been published or a subscription has been activated.
4. Bid terms
By submitting a bid offer on ticx.com.au, you acknowledge and agree that:
- A bid is a promise to purchase at the price you have offered
- You have the ability and genuine intention to purchase the share of ownership on offer for the amount of your bid if accepted by the vendor
- You must not place a bid if you have no intention of purchasing the ownership share being offered
- Bid offers are forwarded directly to the vendor or their agent — ticx.com.au plays no role in bid acceptance, negotiation, or the resulting transaction
- Submitting a bid does not create a binding contract of sale — that is formed between buyer and vendor through their respective licensed agents under applicable Australian state law
5. TIC loans marketplace
The TIC loans section of ticx.com.au is a lender enquiry matching service only. ticx.com.au is not a lender, mortgage broker, credit provider, or Australian Credit Licence holder, and is not licensed as such under the National Consumer Credit Protection Act 2009 (Cth).
Loan enquiries may be shared with specialist TIC lenders who may contact you directly. ticx.com.au does not guarantee that any loan enquiry will result in a loan offer. All lending arrangements are subject to applicable Australian credit laws.
6. No financial product advice
ticx.com.au facilitates the listing and discovery of direct real property ownership interests — specifically, Tenancy in Common shares in real property. These are direct ownership interests in real estate, not financial products, managed investment schemes, or securities as defined under the Corporations Act 2001 (Cth).
Nothing on this platform constitutes financial product advice. ticx.com.au does not hold an Australian Financial Services Licence (AFSL) and is not required to hold one in connection with the services it provides. Always seek advice from a licensed Australian financial adviser.
7. Prohibited conduct
You must not use ticx.com.au to:
- Submit false, misleading, or fraudulent listings or bid offers
- Impersonate any person or entity, or misrepresent your identity or qualifications
- Violate any applicable Australian federal or state law or regulation
- Violate any applicable anti-discrimination legislation
- Attempt to manipulate listing prices or bid activity
- Engage in conduct constituting misleading or deceptive conduct under the Australian Consumer Law
- Scrape, harvest, or systematically collect data from the platform without prior written consent
- Use the platform in connection with any unlicensed real estate activity
8. Limitation of liability
To the maximum extent permitted by Australian law, TICX Pty Ltd, its directors, officers, employees, agents, and successors shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the platform.
Our liability to you under the Australian Consumer Law for any non-excludable guarantees is limited, to the extent permitted by law, to resupplying the relevant service.
9. Governing law
These Terms of Use are governed by and construed in accordance with the laws of the State of Queensland, Australia. Any dispute arising from or relating to these terms shall be subject to the non-exclusive jurisdiction of the courts of Queensland.
